Living Trusts A living trust is a legal document in which you may create a separate legal entity ("trust") to hold some or all of your property. People create living trusts for many reasons. You may, for example, create a living trust that names a trustee to manage your property upon your incapacity or distribute your property upon your death without direct court supervision.
